This is a podcast episode discussing Erica Jurati, a reality TV star from The Real Housewives of Beverly Hills, and her marriage to lawyer Tom Girardi. Erica had dreams of becoming a singer and actress, but her plans shifted when she married Tom. Tom is a successful trial lawyer known for representing victims against corporations. Despite their significant age difference, Erica and Tom got married and lived in a lavish mansion. Erica defended their relationship, claiming it was based on love and not money. Tom had a successful career, winning billions of dollars in settlements for his clients. Welcome to Serials and Schemes. I'm Sam and I'm Sandy. This is a true crime and conspiracy podcast. Our podcast is intended for mature audiences. Listener discretion is advised. Hi guys and welcome back to Serials and Schemes. If you're new here, hi I'm Sandy. And I'm Sam. Today Sandy is going to be getting into a reality TV star broadcast. And with that said, we are also having a little tipple, a little drink. So the reason why we are having a drink is because this is, it is true crime, but it's also a spilling of tea really. And Sam loves a bit of tea. But Sam, this means you can see a reality TV. No. You don't, eh? No. So for the sake of storytelling and just some background on this reality show we're talking about, today we're getting into Tom and Erica Jurati. So for a lot of people, these are household names. But for those of you who don't know, Erica Jurati is on the cast of The Real Housewives of Beverly Hills. And honestly I'm a huge fan of reality TV. Probably because for me it is a great outlet. I like that nice balance from all the other true crime and not true crime that I can see in it. But yeah, so for those of you who don't know, there are several franchises of The Real Housewives, which is made and produced by Bravo TV. There's The Real Housewives of Atlanta, Orange County, New Jersey, and so on. Many, if not all the women on the show are business women currently. But also, most of them started out as actual housewives. A lot of them came into money through either their husbands or from their families. One of my personal favorites out of the franchise was The Real Housewives of Beverly Hills. And so with that said, let's kick off with Mrs. Erica Jurati. She was previously born as Erica Chahoy, born on July 10th of 1971 in Atlanta, Georgia, to a single mother, Renee Chahoy, who was only 18 years old when she gave birth to Erica. Erica's father unfortunately left them when she was only little, so her and her mom moved in with her parents in the Conyers, Georgia. Conyers? Do you know what's in Conyers? No. That's where the originals were filmed. Oh, is it? Yeah. I mean, that is dope. That's New Orleans of the originals in the Vampire Diaries. When I saw that she was born in Atlanta, and you know, her whole upbringing is in Atlanta, I was like, she'll love it. Yeah. I was like, I've been there, I've been there, I've been there. At one time, I've traveled to Conyers. But I also went to Conyers and walked around and like, saw all the French Quarter of, yeah, Conyers. Slay. Okay, well, we've got to fuck. She's hooked. Sign me up. What time is it? Beverly Hills. And it's Atlanta. Okay, cool. Erica grew very close to her grandmother and attributes a lot of her confidence and sense of humor and strength from her. As a child, Erica had big aspirations. She loved to sing and dance, and she took part in musical theater and had dreams of performing and working within the entertainment industry. She was a young girl who vowed to never become reliant on a man. And this kind of does happen for her, but we'll get to that. In October of 1989, just a few months after Erica turned 18, she decided to move to New York to chase her dreams. While there, she got a job as a- Hey there. Just in case you didn't catch it, Sam's in there as well. It's important to indicate Sam's in there. While she was in New York, she landed a job at a famous go-go strip club called Shakers in Lodi, New Jersey. So while working at Shakers, she managed to make some connections and started doing a little bit of modeling, even landing herself a role on two episodes on the show Law and Order, along with other small acting roles in the early 90s. But what Erica really wanted to do- Law and Order, like it's the one that's done in New York? Yeah. I miss it. Okay. Trigger warning, Sam will be flexing throughout this entire episode. Yeah, so she landed a couple of other small acting roles in the early 90s. But what Erica really wanted to do was become a singer and perform. Now, I read that when Erica turned 18, she was briefly a member of a girl band called The Flirts. Apparently, she was turning in for another member and recorded a few tracks with them. That's probably what concerned her calling in music. However, her plans deviated a little when she met a DJ by the name of Thomas Wiseau, and there was an instant connection and the pair got married in December of 1991. And then in 1994, Erica gave birth to their son, Thomas. Sorry, going back. When was she born? What year was she born, sorry? Erica? Yeah. She was born on July 10th of 1971. Okay, cool. I'm just trying to engage. No problem. So after two years, Erica divorced Thomas Wiseau, moving to L.A. with her son. At the time, it was one of the best opportunities for acting and anything within the entertainment industry. L.A. was the best. Hollywood. Yeah. After moving there, she managed to learn a few acting gigs but nothing notable of consequence. Erica worked a lot as a waitress and she ended up working at a restaurant called Chessons in West Hollywood. People that frequented Chessons were often, like, wealthy and had some kind of, like, stature or fame. Some were in politics and so on. So that means that Erica was constantly serving and waiting on people that could potentially help her in her career. And that actually included the co-owner of the restaurant, Thomas Girardi, who was also very, very well-connected. So Thomas Vincent Girardi was born on June 3rd of 1939 in Denver, Colorado. Okay. So he graduated from Loyola High School, which was a private Catholic all-boys school. He then continued his private education at Loyola. Oh, my God, this is such a hard word. Loyola Marymount University for his bachelor's degree. And then went to... fuck this... honestly, fuck this name. Went to Loyola again for law school for his JD, otherwise known as LSATS. And after that, he went to New York University for an additional year of studying and earned a postgraduate degree specialising in consumer law. Holy moly. Yeah, which was... which was called an LLM in 1955. And that same year, he ended up starting his own law firm, partnering with a friend named Robert N. Keith. They began the Girardi-Keith Law Firm, which would be very successful. Girardi and Keith have recovered $10 billion worth in settlements, mainly from representing victims of corporations. And by 2003, Tom would be inducted into the Trial Lawyers Hall of Fame in the state of California, which I'm sure this, paired with his connections, made him even more appealing to Erica, who was working for him at the time. What was she doing for work like that? Okay. Um, yeah. So she was also only 28 years old at the time. She was stunning, leggy, and blonde. Tom knew from the moment he saw her that he absolutely had to have her. Um, and so... So she made this man work. Um, they got to know each other for about a year before Erica would even give him his phone number. Oh, my God. Give him her phone number. Apparently, he first tried to get the number through his assistant, tried to call her and say, like, you know, Tom is interested. I'd love to have your phone number for him. And she was like, no, sweetie, if he wants my number, you need to come get my number. Yes. I was not having a single bar of that. So Tom did, and then the rest was basically history. Um, they got on their first date, and yeah. So after this date, they started dating, and they were actually married in just six months. At the time, Tom was more than 30 years Erica's senior. When you know, you know. And he obviously had a lifetime worth of experience, but that didn't seem to matter to either of them. Erica would always say on The Real Housewives that she was not married for money, that she would always say that they were married for love, and that was the one thing that was always really pushed. She always really pushed that. Um, she said, I'm not a gold digger, and this is obviously what a lot of people needed her to be, especially after being on the show. Um, viewers saw her as a, you know, a gold digger. Um, she, however, attributed her attraction to Tom's intelligence, his positivity, and of course his success, that he was also incredibly caring to her and supportive of her career goals. So, of course, it wasn't long until Erica quit her job as a waitress, stopped acting for the time being, moved into Tom's 1920s-era mansion in Pasadena, California. Right there. Um, and this place is fucking gorgeous. I need to show photos to Sam real quick. If we remember, we'll put them into the Instagram post. We always say that we're going to put shit into the Instagram post, but we always forget. It's insane. This is just, like, leading into their home. Oh, my God, it's so pretty. It's like a full, like a full mansion. I'm trying to get, like, an aerial shot for you. Wow. Yeah, it is massive. And covered, like, surrounded by trees and stuff, so it's very private. Very private. So, before marrying Erica, Tom had already been married twice, but, in quotes, he said, this time it was different. And he also really embraced his role as a stepfather to Erica's son, Thomas. And as a trial lawyer, Tom really tried to be a people's lawyer. He was there to represent the people who didn't have voices to represent themselves, to represent, like, you know, to represent victims. He was the champion of people. He would go head-to-head with the most powerful international corporations, pharmaceutical, you know, giants, and even major Hollywood movie studios. Tom's first major victory as a lawyer was actually back in 1970. He was one of the first lawyers in California to get a client over a million dollars in medical malpractice lawsuits. So, in Tom's career, he won over $1 billion from the healthcare industry and over 30 verdicts of at least $1 million settlements for his clients, including $785 million for the employees of Lockheed Martin Skunk Works, who had suffered personal injuries while on the job. He also won $45.5 million from Ford Motor Company after a defective seatbelt paralyzed a six-year-old. So, you can see why Tom has this reputation of being a people's lawyer, or people's hero even. You know, he was always going to help victims and make as much money as he could from these greedy corporations. He also became a recognized public figure. Robin Hood of... Hey? Like, the Robin Hood of legalism. Yes, literally, like a legal Robin Hood. Yeah. So, he became a recognized public figure, and when he represented the residents of Hinkley, California, against the Pacific Gas and Electric, otherwise known as PG&E, they're a utility company who was accused of contaminating people's water, leading to many people developing cancer and other serious illnesses. This was a really serious lawsuit, and in 1966, PG&E agreed to pay $333 million, which is massive in the country. Yeah, it's huge. So, Tom really seemed like the lawyer of the people, a man who seemed to really want to help and could really get the job done. And the way that they were able to do so well, Tom was able to accumulate so much wealth, and it's because they took on cases under contingency, basically meaning that if they're able to win the case for you, they'll take a percentage of the settlement. But if you lose the case, they don't take anything. So, because of the risk involved with taking on a case and not charging, if they lose, they get to charge a higher percentage out of the final settlement and make quite a lot of money. So, sometimes these cases would settle for huge amounts. If people won their cases, Gerardi-Keith was keeping anywhere from 25% to 40% of the final settlement, which is massive. That's huge. So, if you're thinking about $300 million, that's a lot of money, especially in the 60s, right? Yeah, in those pockets. Yeah. So, Gerardi-Keith was also known as the place to work. All students from all over the place were clamouring to get in there. Yes. They had amazing work conditions, they paid really well, and they also had amazing connections, and they gave, like I said, a lot of benefits to working there. They also did things like luxury company cars and designer suits to actually fit the lawyer's reputation with the firm. Yeah. They even had their own box at the Staples Centre that all the employees could use, and you get to go to all these amazing places. We were born in the wrong era. We really were. Actually, I would have been a lawyer, I think, because I wanted to do that as a kid. I've done a legal diploma, so I could be a legal executive. You should do it, because I feel like it's good. Fuck the confidentiality. Yeah. Yeah, so they would get to go to all these parties. I'm just showing you the pictures so that you understand how wealthy this firm was. If you're in with the Johnny Keys group, you'd be going to the Super Bowl parties and massive celebrity holiday parties, and you're mingling with a ton of high-profile people. Where are they based at this point, in LA or in New York? I believe in LA. Yeah. Every year, Tom would have this big conference in LA with his employees, and they would go all out for this. Tom was really well-known for hiring really famous entertainers for all these parties, like Leanne Ryan, Jay Leno, Penn and Teller. He was friends with people like Jenny Cochran as well, which, if you've heard about OJ Simpson, you'll know who Jenny Cochran is. He was also friends with the governor, like Governor Jerry Brown and Senator Harry Reid. He was just really, really well-connected. Years up there. Yeah. So you really never knew who you were going to meet at these parties, what opportunities you might run into. Tom was also a trustee at the Library of Congress in Washington, D.C., and he was on the prestigious James Madison Council as well. He also became the first trial lawyer to serve on the California Judicial Council, and Governor Gavin Newsom appointed him to be the Judicial Selection Advisory. Wow. So that's pretty massive. Those are people who get to evaluate potential judges and so on. Yeah. So this is why this whole thing is so fucking salacious, because of who he is. So recently, a documentary came out on all of this called The Housewife and the Hustler. Okay. And in it, there were some judges talking about how Tom Girardi was kind of above judges, even. He could point to them and be like, hey, come over here, and they would go over to him. Yeah, right. Yeah. He had a lot of power in the whole legal system in California, and not only that, he was a major donor in California politics. So we know that he gave at least $7.5 million to various candidates over the years. In 2019, Tom and Erica hosted a fundraising event for Joe Biden. In 20... In 2019. Oh, wow. Okay. Yeah. For Joe Biden at the Jonathan Country Club, which is a very famous private country club in downtown LA. So you can imagine, Erica had a very lavish lifestyle with Tom. They were constantly on trips, flying all over the world. They have an international jet. And then they were... Sorry, they also have a smaller one for domestic flights. So imagine that. They've got two aircrafts, you know, and they're just living... Oh, how the other half lives. Literally. But by 2007, Erica was getting bored of being in Tom's shadow, and she wanted to be in the spotlight once again. So it was around that time that she asked Tom to help her, you know, create a career in music, and he basically helped her finance that. Tom really loved her, so he would have done anything to help her get to that. He believed in her aspirations and all of her goals and would throw any amount of money at her that she wanted, really. She could have just said, like, I want to sit in a pink house all day, and he would have done that. Yes. This is when Erica actually then becomes what she's known as today, which is Erica James. That's her stage name. Okay. Her first single was called Rollercoaster, and for the next several years, she released multiple singles, one after the other. Some were actually featured in films like Hit and Run in 2009, and her song American Summer appeared in that TV show called American... I think the song is called American Summer. Okay. ...in 2011. Tom was always cheering her on and trying to get her as many opportunities that he could find. At one time, he planned a performance for her, but this wasn't at any event. This was the Italian American Lawyers Association's annual Supreme Court night in 2011. Tom was the association's... Random. So random. Yes, it's very random, but like I said, he was grabbing any opportunity to perform, right? Yes, yes. Get to... Yes. ...in that court night. Tom was the association's president and chose the evening's entertainment, which was... My God. ...a screening of his wife, Erika Jayne's music video for the song Party People. That's pretty fucking awkward because this event was held at the Baltimore Hotel Ballroom, so it usually features people like really classic entertainment like an orchestra, a violinist, a cello player, but they literally played this music video in front of a room full of lawyers and judges. I feel second-hand embarrassment. And you don't even know the song yet because I'm not about to show it to you, so I'm going to play you guys the sound of what the song sounds like. Okay. And bearing in mind, this is at the Baltimore Ballroom. This is like not... Procedure. This is not a fucking concert. It's not a gig. She's not opening for... You know? Yeah. No, they're not ready for this. So, this was played in front of a bunch of prestigious judges and lawyers. So, people that would actually be all about like your classic, classical, you know, like you say, orchestra type style and they're going to pop. Okay. And even if they don't like classical music, if you have money and you're going to these events, you're going to fucking pretend to like it. This is not something that you go, Woohoo! This is what I want to see at the Lawyers and Judges Association. Yes. You know? It's not about getting wrecked. That song, though, it screams, yeah. So, people were like, you know, this is a shit show. Yeah. This is not okay. But this did not stop her. And I honestly... Was she there? I think so. I think so. She was attending it as a live and screened music video. Yeah. But this obviously, even though this was a complete fucking failure in a fiasco, she was like, yep, that doesn't stop me. I'm having fun. So, she continued to use Tom's money to help give her an edge in the entertainment industry. She actually ended up hiring Michael Jackson's choreographer, Lady Gaga and RuPaul's costume designer, and Andy's songwriter who worked with big names like Madonna, Britney Spears, and Stevie Nicks. At one point, she had nine hits on the Dance Club chart for the Billboard. And that was kind of becoming her thing. It was her niche. But despite her growing popularity and how much she was enjoying it all, she really wasn't making any money. Tom wasn't getting much... She wasn't spending too much money. Correct. And she was actually preparing to retire from the entertainment industry when she was actually offered another job. And this was... This is how most people know her now. She got cast on The Real Housewives of Beverly Hills for the sixth season. Yep. And honestly, the show was getting pretty boring. And she came on, and she is... If you were to watch her on the show, she's actually a really interesting person. Okay. I know that she's a cancerian, but I know that they are, by nature, really creative, really into music. But they're also very complicated people, and she was no different. So she has got this very entertaining edge to her. She's very different. But yeah, and so she got to show off her skill on the show. She's just interesting to watch. And the show started actually doing way better once Erica was part of it. Yes. And it was also beneficial because she got to show off her music and get new fans. And the thing is, with The Housewives, with the show, is that all the women, like, the whole thing was to select how much wealth you've got. Who can say the best party, who's got the most connections, who's written the latest... It's all about images, right? Yeah. Yeah. And so it's always about that, you know, who's got the nicest dress, the most brand names, all of that shit. It's very, very OTC. Yeah. Erica, like, flew all of them out of the water with how much money she had. In her first episode, Tom and Erica actually show off their private garden, which I showed you a part of it. With the pool. Yes. She also showed off, like, how much her glam squad was worth. Like, they traveled with her everywhere. She has a huge wardrobe. Like, it's a whole room. You walk in, I reckon, like, one of her designer items would be worth both of our closets combined. Mm-hmm. So, yeah, so she had this, like, you know, she had this persona where she was like, I'm a big baller. I, you know, I have all of this access. But I'm also very talented, like, you know, she showed off many different facets to who she was. Yes. But in 2017, she actually released probably one of her biggest songs to date. And it's called It's Expensive to Me. Let me just... Oh, dear. Everybody knows that I'm a million dollar actress. I'm reckless, I'm senseless. I take your love for granted. My business is practice and you're the one that takes it. I'm reckless, I'm senseless. I take your love for granted. My business is practice and you're the one that takes it. I'm reckless, I'm senseless. I take your love for granted. Thousands later, he was completely unconscious and this explosion that was caused by PG&E, the company that we talked about earlier that contaminated all the water, it was caused by their gas line erupting and Joe's house and dozens more were completely leveled. Like nuts. Wow. The footage is crazy just seeing the amount of houses that are on fire and stuff, it's crazy. His girlfriend, Jessica's body wasn't found for quite a few days. She had somehow gone into the shed in the backyard and died there. But the chance of him surviving was extremely low. He was in the hospital in a coma for quite a long time and he had burns all over his body. At least 80% of his body was covered in burns. His lungs were severely burned inside as well. His mother, Kathy, got to the hospital as fast as she could and she was just overwhelmed by everything and did not know what to do, didn't know how many injuries he sustained and how long he would need medical assistance for but she knew that he would be a lawyer. He would need medical care for the rest of his life. She got connected with Tom Girardi and she got connected through her friend named Kim. Kim was her best friend and they've been friends since they were three years old. They've raised their kids together and so families were really close so she would have trusted anyone that Kim recommended. Kim thought Tom Girardi was the man to go to for this kind of thing. He was always doing these lawsuits. Kim was actually a legal consultant and that's how she had the connection to Tom. Tom had already been to the PG&E twice and won both times so she thought they'll be in really good hands. Tom actually visited Joe at hospital and Joe said that he was the first person he remembered seeing when he woke up out of his coma and that he made him feel like everything was going to be fine. About a year and a half after the explosion Kim, the friend connected Tom and the family and she began working for him. Okay. Tom then took her under his wing and told her everything he knew about the law and helped her move her career for the next seven years that she would be He treated the family really well and Joe and his mum became like family to Tom. Tom would take them to dinners and you know check in with them all the time. To them he seemed really funny, intelligent, caring and really liked them and they trusted him a lot. So it turns out that the explosion was caused by a faulty pipe and so PG&E were definitely responsible. So it was pretty much a slam dunk like they before the trial they were brought into mediation and when they got there Tom told them that the case had already been settled. There was no trial. It was all done which was relieving for Joe and his family. He'd never lived through the trauma again and he said he was happy with the settlement amount which there's nothing conclusive as to how much the settlement actually was but it would be enough to cover his future medical costs and then some. So after Gerardi and Keith took their cut the final earnings the rest of that was put into a trust and it was supposed to be held there but in this situation lawyers do not touch the money for any given reason it's one of the biggest rules and if you get caught taking any of this money that belongs to your client you can get disbarred very very quickly. So Tom ends up talking to Joe and tells him hey like instead of us paying you out from the trust why don't you give some to me and I'll help you invest it and he personally guarantees Joe a 6% return on this investment which is above you know all banks' returns and he said there was absolutely zero risk of loss. I just want to say something guys if anyone approaches you whether they're a lawyer an accountant and they sell you on an investment there is always a risk of loss always yes So Kathy and Joe believe him and this was Tom they trusted him they didn't really know what the investment was and when it came time to collect from the investment Tom actually began giving them a bit of a fucking muck around he started telling them that there was this judge Justice Pennelly said that he said that he told Joe that Justice Pennelly was worried about him and wanted to make sure that he would be well taken care of according to Tom Justice Pennelly wanted Joe to take his settlement in smaller amounts because it might be better for him in the long run which again doesn't make sense but then eventually the payment to Joe stopped just stopped coming up like cold stopped and Tom started using the excuse of oh Justice Pennelly he won't let me give you the money I don't even know why but he would always end it by promising like it's all Justice Pennelly's fault you know Joe said the money would come in sometimes the following week and sometimes it just wouldn't come in at all and he got the vibe that something was seriously wrong and Tom would leave them voicemails and I'll let you play one for you guys this is Tom to Joe yeah and how cunning and how convincing like a dog because and how cunning and how convincing he really was this is Tom Girardi calling I don't want you mad at me anymore I don't want you mad at me I'm working like a dog to try and get this thing resolved as you know there's there's part of this is that the next cases have to be signed like and there's some various groups together I managed to cut you out of that group because the others are not resolved yet then although the bankruptcy court was great I gotta get approval of the regular court of the whole thing the courts are closed as you know and it isn't my fault I mean I would more than anything like to see you get your money and get out of here and like me and everything be sweet um I I saw the assistant presiding judge at a at a trial lawyers event and I said I have some real problems it's nothing through the courts it'll take 10 seconds but I I gotta get some sign offs and you're not the only one I have and he said Tom he said give me 2 weeks I'll make sure I'll get you a person so as you can hear man is full of fucking yards of excuses and he sounds like Winnie the Pooh literally and like if you were hearing an old man sound like Winnie the Pooh you'd be like yeah okay it's alright he's very calm and he doesn't sound stressed and it's just very oh okay like he's doing yeah exactly it's like classic manipulation tactics using a kind voice so basically Tom was just trying to convince Joe that he needed money for his case and she tried to help him figure out what's going on as she looked through she couldn't find any legal reason why the money wasn't actually being given to Joe like none of it made sense but meanwhile Joe's medical bills are piling up and he's scheduled for more surgery soon so he needs more money for the settlement but he had not been telling Tom anything about what Joe should do with his money or how the settlement should be doled out but around this time Kim's son Paul died in a motorcycle accident so all of them kind of had to put everything on everything that was going on with Joe and around that time she hired Tom for his son's case her best friend's son is still having issues getting his little money from Tom and eventually payments were stopped altogether the last check came in January 2017 and there was nothing more after that they knew that something bad had happened and they decided that they were going to put everything on Joe's case but we started getting out around other lawyers and the firm clients were being given settlement money and there were all these other issues going on and they were going to hire another lawyer who was going to help them get the settlement money from Tom they filed a lawsuit against Tom and Tom agreed to pay them $12 million they set up a payment plan it was on Zoom as well he was asked quote do you have any
