Mrs. Stowers found a telephone at Ardmore Acres and contacted her family in Texas for help. They assisted her in getting a court order for her release from the hospital. She filed a lawsuit against Dr. Wlodzko and Anthony Smyk. Ardmore Acres and Smyk were dismissed, but Dr. Wlodzko's case went to trial. The jury found him guilty of assault, battery, and false imprisonment, and awarded Mrs. Stowers $40,000 in damages. It is clear that Dr. Wlodzko unlawfully restrained her against her will. So, nearing the end of her hospitalization, Mrs. Stowers did find an unlocked telephone at Ardmore Acres where she contacted her family in Texas. Her family in Texas did assist her in finding a legal representative to assist her in gaining a court order for her release. So, on January 27th, 1964, she was released from Ardmore Acres. After being released, Mrs. Stowers filed a suit against Ardmore Acres Defendant Dr. Wlodzko and Anthony Smyk. Defendants Ardmore Acres and Smyk were dismissed prior to the trial. The Defendant Wlodzko requested a directed verdict. So, the court granted the motion as to the counts of malpractice only, but allowed the counts of assault and battery and false imprisonment to go to the jury. The jury returned a verdict for plaintiffs in the sum of $40,000. Due to false imprisonment being the unlawful restraint of an individual's personal liberty or freedom of locomotion, it is clear that the Defendant Wlodzko is guilty of this act and it is apparent that the plaintiff was, in fact, restrained against her will.
